Vacation Rental Agreement:

This Vacation Rental Agreement (“Agreement”) between Cornerstone Guesthouse and “you” (or other variations of such pronoun) is for rental of the vacation rental property (the “Property”) specified in a confirmed reservation.

By booking your rental Property, you acknowledge that you have read and understood and agree to be bound by, all terms, conditions, and policies in this Agreement and any other published policies.

The description of the Property set forth on our website or the portal you used to book your stay, including without limitation, the parking limitations, and maximum occupancy information (the “Property Description”), is part of this Agreement and is incorporated herein by this reference.

Minimum Age:

You must be at least 21 years of age to rent the Property. You hereby confirm that you are at least 21 years of age.

Payment Procedure – Details of Stay: 

Your deposit of 40% is required to hold your reservation.  Your dates will be reserved once your deposit is made. Balance due thirty days before arrival. If you are arriving before the thirty days, the total amount is due.

Security Deposit:

A security deposit equivalent to one-night stay will be required through bank transfer or charged to your credit card on file with us 30 days before your arrival date or if you book less than 30 days in advance on your booking date. This amount is fully refundable after check-out (up to seven days) as long as the villa is left undamaged and all inventory is accounted for. We do not accept checks. If you do not book direct and instead book through a third party, additional fees and refund and deposit policies may apply (but all other terms and conditions remain the same). Please review the policies of any third-party booking sites before confirming your booking.

Responsible Renter:

You are the responsible renter of the Property, and you agree to be an occupant of the Property for the entire duration of the rental. All other occupants will be family members, friends, other responsible adults over 21, or accompanied by a parent or legal guardian. You agree to be solely responsible for your actions and the actions of all family members, guests, and invitees (collectively, “Occupants”) present at the Property at any time during your stay, and to ensure that all Occupants understand and comply with the Terms. 

Good Neighbor Policy:

Quiet Hours: We enforce a good neighbor policy. Please treat the Property with the same care you would use with your residence and leave it in the same condition it was in when you arrived. To prevent theft of or damage to furnishings or your personal property, you agree to close and lock doors and windows when you are not present at the Property and upon check-out. You and your Occupants agree to conduct yourselves throughout your stay in a respectful manner and not disruptive to neighbors, traffic flow, or the community. That will not prompt complaints to us from police, neighbors, or neighborhood or homeowner associations.

Parking

Parking is provided. The Guest is liable for the security of their vehicles while staying at the Rental Property.

The Property is limited to a specific amount of parking (4 vehicles), as outlined in the Property Description. You and your Occupants agree to abide by all applicable parking restrictions and limitations. Please contact us if you have any questions about parking.

Maximum Occupancy:

  • The number of guests in a room is limited by the number of people the room can sleep as advertised. Other restrictions may apply. If maximum occupancy is exceeded, you may be required to check out immediately.     
  • The listed “MAXIMUM LIMIT” of twelve (12) paying adults and four (4) children ages 3 to 12, indicates the maximum number of occupants allowed at Cornerstone Guesthouse at any one time. (Exceptions for infants under age 3 only) 

No Smoking:

No smoking is permitted at the Property (including on porches, decks, or outdoor areas). “Smoking” means inhaling, exhaling, breathing, carrying, or possessing any lighted or electronic cigar, cigarette, pipe, vaporizer, joint, or other tobacco or marijuana product in any manner or in any form. No marijuana, medical or otherwise, may be used, grown, stored, or consumed on the premises.

Events and Commercial Photography; Structures:

Events and commercial photography or filming are prohibited at the Property without our express written permission. (If approved, additional conditions and fees may apply.) While occupying the guesthouse as a renter, prohibited events include parties, meet-ups, weddings, receptions, concerts, and other similar events. No tents, canopies, or other structures may be erected on the Property. This is only possible with a separate contract for an event.

Pool Use:

You and your Occupants use the pool at your own risk and HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DEATH, OR PROPERTY DAMAGE RESULTING FROM USE OF THE POOL. Please shower before entering the pool, and there should be no diving in the POOL. Please do not consume food or beverages inside the POOL. The POOL is not suitable for intoxicated persons.

Check-in and Check-out:

Check-in: 3:00 pm

Check-out: 11:00 am

Early Check-In/Late Check-Out:

Early Check-in: If there are no check-outs on your arrival day, we may be able to offer you an early check-in (before 3 pm.)

Early check-in from 1 PM: no charge;

Check-in from 10 AM to 1 PM will attract an early check-in charge of $75USD (or $525 TTD).

Late Check out: If there are no guests arriving on your departure day, late checkout may be possible; please check with the property manager.

Late checkout to 1 PM: no charge;

Checkout from 1 pm to 4 PM will attract a late charge of $75USD (or $525 TTD).

Housekeeping and Maintenance Issues:

Property Conditions:

The Property is provided AS-IS, and we are not responsible – nor will you be provided with any discount – for the inoperability or unavailability of any amenities (including, without limitation, any phone or internet service, air conditioning, TVs, cable, and pool). You agree to contact us as soon as you notice any maintenance or housekeeping problem, or any potentially hazardous condition, or if any incident occurs at the Property related to such a problem or condition. We will take reasonable and appropriate steps to remedy any reported problem as soon as practicable. We may enter the Property to rectify any problem you report at reasonable times and with reasonable notice to inspect, maintain, or repair the Property and address any situation that we reasonably deem an emergency that threatens persons or property. We provide an initial supply of toilet paper, bath soap, clean bed linens, and towels. We do not replenish products during your stay.

Your Cleaning Obligations:

Please leave the Property in the same general condition as when you arrived. Clean all food and drink spills immediately. Be aware that food and drink spills on furnishings constitute damage to the Property (and not normal wear and tear). Remove all of your food from the refrigerator and clean any spills you are responsible for inside the refrigerator and microwave. Do not leave dirty dishes; clear dishes from the drainboard. Please clean the grill if used. Staff will arrive either when you depart or shortly after your departure to thoroughly clean and inspect the Property.
Criminal Activity Prohibited: Use of the Property for any criminal activity is prohibited and may result in fines or prosecution. This prohibition extends to using the Property’s Internet service, if any, for illegal activity.

Refunds:

No full or partial refunds will be granted for no-shows or if you cancel within 14 days of the first night of your reservation, arrive after the first night of your reservation, or depart before the last night of your reservation. No refunds or compensation will be given if the Property is unavailable (or available but difficult to reach) for any reason outside of our control. This includes but is not limited to adverse weather conditions, natural disasters, mechanical failures, acts of government agencies, or utility outages. We advise our guests to obtain appropriate travel insurance. In addition, for any unforeseen circumstance. Due to Covid-19, we will reschedule your booking to anytime in the future, based on availability.  No refunds will be granted.

If you do not book direct, and instead book through a third party, additional fees and refund and deposit policies may apply (but all other terms and conditions remain the same). Please review the policies of any third-party booking sites prior to confirming your booking.

Cancellation:

Refunds on cancellation are subject to the amount of notice (weeks) given between formal cancellation and the expected date of arrival, as follows:

  • 8 weeks or more: Full refund of the deposit, less any Bank/WiPay/Credit Card charges incurred by us when accepting and/or refunding payment.
  • 4-8 weeks before arrival: Refund of 75% of rental costs paid, less any Bank/WiPay/Credit Card charges.
  • 2-4 weeks before arrival: Refund of 50% of rental costs paid, less any Bank/WiPay/Credit Card charges.
  • Less than 2 weeks’ notice: Loss of all rental.

Property Damage: 

Security deposits will be used to cover the cost of damages, whether paid via deposit or credit card.  The guest will pay for all damages incurred while the guest is staying on the property, even if the offender is being hosted by the guest. You will pay for the full cost of the damage incurred, and any excess will be charged to the guest.

Terms of Eviction:  

Guests will be evicted for excessive noise, smoking, shared and private property damage, disturbing the peace, and unauthorized use of the Property. There will be NO refund once evicted.

Note:

If you are evicted from the room or guesthouse, which you are occupying for failure to abide by the Property rules or failure to abide by the rules listed herein. In that case, you will NOT be entitled to a refund of the monies paid in advance and the security deposit, and you will be responsible for damages to the guesthouse caused by you or your guests. 

Travel Protection Insurance:

In case of any unforeseen events, this insurance may help protect your vacation investment. 

Choice of Law and Venue for Disputes:

The law of Trinidad and Tobago shall govern this Agreement without regard to its conflict of laws provisions, and both parties consent to the exclusive jurisdiction.

Loss/Theft:

We assume no liability. The Guest is 100% liable. Cornerstone Guesthouse assumes no responsibility for any loss or theft of Guest’s personal property or items left behind in units. Cornerstone Guesthouse assumes no liability for theft or damage to vehicles or items left in them. 

Indemnity:

You agree to hold harmless and indemnify The Guesthouse for all losses, damages, and claims for property damage, personal injury, or monetary loss (including attorneys’ fees) resulting from your actions or omissions, and the actions or omissions of your Occupants, during your stay.

Substitution of Property:

On rare occasions, due to ownership changes, Property being removed from rental use, or a need for extensive repairs or maintenance, the Property may not be available for rental on the dates of your reservation. In this unlikely event, we reserve the right to substitute a comparable property. If comparable accommodations are not available, you will have the option of (1) selecting from other available properties (in which case you are responsible for, or will receive the benefit of, any difference in cost) or (2) receiving a complete refund of your reservation payment. In the event of a substitution of rental properties, all terms in this Agreement, plus any terms outlined in the Property Description specific to the substituted Property, shall apply to your stay in the substituted Property. 

Additional Matters:

Please refrain from publishing any untrue disparaging remarks about the Guesthouse, including its employees and agents, or the Property. We reserve the right to seek redress for defamation libel or slander) to the fullest extent of the law. We reserve the right to reject your request for occupancy or to cancel reservations (with a full refund) at our sole discretion. This Agreement may only be amended or modified by a writing signed by you and an officer of the Guesthouse. You understand that the Guesthouse’s non-management level employees, do not have authority to accept, modify, or waive any term or condition set forth herein.

By acknowledging and accepting this Agreement, you agree to opt into communications from the Guesthouse via phone, e-mail or other communications. You may opt-out after receipt of said communications according to all pertinent laws and regulations regarding such communications.

By signing or acknowledging the Agreement, you hereby agree to all of the terms and conditions of this Agreement.
